1. About these Terms

These Terms and Conditions form a binding agreement between QarGo Digital Solutions & Car Brokerage (“QarGo”, “we”, “us”) and every person who accesses or uses the QarGo website, application, booking tools, self-drive services, car-with-driver services, support channels, payment services, or any related product.

By creating an account, confirming a booking, opening a vehicle, requesting a driver, or otherwise using the service, you confirm that you have read, understood, and accepted these Terms.

2. Eligibility

You must have legal capacity to enter into a contract. Self-drive users must be at least 21 years old, hold a valid driving licence accepted in Qatar, meet the insurer’s eligibility requirements, and successfully complete identity verification. Additional age or licence-history requirements may apply to specific vehicle categories or protection products.

3. Accounts and Security

You must provide accurate, complete, and current information. Your account is personal and may not be transferred, shared, sold, or used by another person. You are responsible for safeguarding access codes, passwords, one-time passwords, and devices linked to your account. You must promptly report suspected unauthorized activity.

4. Identity and Licence Verification

QarGo may verify identity documents, driving licences, residency status, payment details, facial images, and other information required for safety, fraud prevention, insurance, or legal compliance. We may suspend access when documents expire, cannot be verified, or appear altered or misleading.

5. QarGo’s Role

QarGo provides a digital mobility platform connecting users with vehicles, fleet partners, and licensed drivers. Depending on the service, the vehicle or transport service may be supplied by QarGo or by an independent partner. The identity of the relevant provider may be displayed during booking or in the booking confirmation.

6. Self-Drive Services

A self-drive booking begins when the vehicle is unlocked or the booking is otherwise activated and ends only when all required return steps are completed and the application confirms termination. Charges continue until official completion. The user must inspect the vehicle, report existing damage, upload required photographs, operate the vehicle responsibly, and return it in the permitted zone and condition.

7. Car-with-Driver Services

Car-with-driver bookings may be immediate or scheduled. Estimated arrival and journey times are not guarantees. Users must behave respectfully, follow safety instructions, avoid unlawful conduct, and pay waiting, cancellation, toll, parking, cleaning, or damage charges where applicable.

8. Vehicle Use Rules

Vehicles may not be used for racing, towing, off-road driving, commercial passenger transport, unlawful activity, carrying dangerous goods, driving outside permitted areas, or by an unauthorized driver. Driving under the influence of alcohol, narcotics, or impairing medication is strictly prohibited. Tampering with GPS, telematics, cameras, immobilizers, or vehicle systems is prohibited.

9. Parking and Return

The user must park legally and only in locations permitted by the app. Underground, restricted, private, paid, covered, inaccessible, or out-of-zone parking may be prohibited. The user is responsible for parking charges, towing, recovery, repositioning, and related administrative costs caused by an improper return.

10. Prices, Payments, Holds and Wallet Credits

Prices shown before confirmation apply to the relevant booking unless the journey changes or additional charges arise. QarGo may place a temporary authorization hold on a payment method. You authorize QarGo to charge fares, rental fees, waiting, mileage, fuel, tolls, fines, damage, cleaning, recovery, late-return fees, and other properly disclosed amounts. Promotional credits are non-transferable and have no cash value unless required by law.

11. Cancellation and Refunds

Cancellation windows and charges depend on the service and are displayed during booking. Approved refunds are returned to the original payment method or issued as platform credit where permitted. Bank processing times are outside QarGo’s control. Users should contact QarGo before initiating a payment dispute so the matter can be investigated.

12. Traffic Violations, Tolls and Government Charges

The user is responsible for all traffic offences, tolls, parking charges, impound costs, government fees, and penalties connected with the vehicle during the booking. QarGo may identify the responsible user to authorities and charge the underlying amount plus a disclosed administrative fee.

13. Fuel, Charging and Cleanliness

Vehicles must be returned with the required fuel or battery level and in reasonably clean condition. QarGo may charge for missing fuel, charging, excessive dirt, smoke, odors, stains, waste, pet-related cleaning, or specialist cleaning. Smoking and vaping inside vehicles are prohibited.

14. Accidents, Breakdown and Emergencies

In an emergency, contact the competent authorities first. Users must promptly notify QarGo, follow instructions, remain at the scene where legally required, obtain an official police report, and provide truthful information. Leaving the scene, admitting liability without authority, or failing to cooperate may affect insurance coverage and financial responsibility.

15. Insurance and Damage Responsibility

Insurance and any collision damage product are subject to exclusions, deductibles, excesses, and the insurer’s terms. Coverage may be denied for unauthorized driving, intoxication, reckless use, failure to obtain a police report, prohibited use, misrepresentation, or breach of these Terms. Users remain responsible for uninsured amounts and damage caused by misuse or negligence.

16. Vehicle Technology, GPS and Remote Control

Vehicles may contain GPS, telematics, diagnostic, camera, and remote-control technology. QarGo may use these systems for safety, fleet management, theft prevention, billing, accident investigation, and enforcement of the booking. Remote immobilization will not knowingly be activated while a vehicle is moving.

17. Reviews, Conduct and Community Standards

Users, drivers, and partners must treat each other with dignity and respect. Harassment, threats, discrimination, violence, fraud, abusive language, and damage to property are prohibited. QarGo may investigate reports, restrict access, or terminate accounts to protect the community.

18. Suspension and Termination

QarGo may suspend or terminate access when required for safety, legal compliance, fraud prevention, unpaid balances, document expiry, repeated complaints, misuse, or breach of these Terms. Urgent suspensions may occur without prior notice. Outstanding obligations survive termination.

19. Intellectual Property

The QarGo name, logos, software, design, databases, text, graphics, and platform content are owned by or licensed to QarGo. No right is granted except the limited right to use the service for its intended personal or business purpose. Copying, scraping, reverse engineering, reselling, or training automated systems on platform content without written permission is prohibited.

20. Availability and Third-Party Services

QarGo does not guarantee uninterrupted service, vehicle availability, driver availability, map accuracy, network coverage, or payment processing. Some functions depend on third-party providers. Temporary interruptions may occur because of maintenance, telecommunications, weather, security incidents, or events outside reasonable control.

21. Liability

To the maximum extent permitted by law, QarGo is not liable for indirect, incidental, special, punitive, or consequential losses, including lost profits, missed flights, missed appointments, or loss of opportunity. Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from fraud or deliberate misconduct.

22. Indemnity

You agree to reimburse QarGo and relevant partners for losses, claims, fines, costs, and reasonable legal expenses arising from your unlawful use, breach of these Terms, damage to a vehicle, violation of third-party rights, or conduct during a booking, except to the extent caused by QarGo’s proven fault.

23. Governing Law and Disputes

These Terms are governed by the laws of the State of Qatar. Parties should first attempt an amicable resolution through QarGo support. If unresolved, the courts of Qatar have jurisdiction unless the parties validly agree to arbitration after the dispute arises or another mandatory law applies.

24. Changes and Severability

QarGo may update these Terms to reflect service, legal, operational, or security changes. Material changes will be communicated through appropriate channels. If any provision is held invalid, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
